Terms & Conditions
Please read these Terms and Conditions ("Terms") carefully before booking or engaging with Magic Hour Character Company, LLC (“Magic Hour Character Company”, "we", "our", "us”). By paying a deposit and/or confirming your booking, you ("client", “clients”, "you", "your") agree to be bound by these Terms.
Services Provided

Magic Hour Character Company, LLC provides professional character entertainment for children's parties and events. Our services may include character appearances, themed activities, games, storytelling, and other entertainment-related performances as outlined at the time of booking.

Bookings and Payments

For private clients, a 50% deposit is required to secure your booking. The remaining balance must be paid by the day of the event, whether with cash or online, unless otherwise agreed in writing. If using cash for the remaining balance, you must hand it to our performer(s) as they are leaving the party/event.

For “corporate” clients, such as libraries, townships, businesses, organizations, etc., you must confirm the details of the booking to secure your booking. The balance can be paid via check or online prior to the event or you may provide a check on the day of the event.

Please note that we can’t hold your preferred date and time without both the non-refundable deposit and booking confirmation for private clients and the booking confirmation for all other clients.

Bookings are not final until you receive confirmation from us.

Accepted payment methods include cash, credit card, PayPal, Venmo, and check.
Cancellation Policy

Cancellations are accepted if they are made at least 7 days prior to the party/event. You will be refunded the entire amount paid prior to cancellation. If a cancellation is made less than 1 week in advance, you will not receive a refund but instead may receive an equal-value credit towards a future party/event.
Gratuity

The package does not include gratuity for the performer. Gratuity is not required but is highly appreciated. It may be added onto the remaining balance in cash or provided via other means as outlined in the “Bookings and Payments” section.
Costumes and Characters
-
The costumes and property of Magic Hour Character Company are very valuable and will not be subject to smoke of any kind, which can damage the costumes. This includes cigarette, cigar, vape, marijuana, etc.

The client agrees to keep smokers away from the performer(s).

In the event of any damage to our costumes and company property, such as food stains, tears, etc., caused by the client and/or guests, the client may be held responsible for dry cleaning, replacement, and repair charges at our discretion.

Magic Hour Character Company is not affiliated with any licensed or trademarked characters. Our characters are inspired by popular fairytales, folklore, and original designs.

Any resemblance to copyrighted or trademarked characters is purely coincidental and not intentional.
Location
-
For extreme heat/cold or precipitation, we recommend holding your party indoors. We also reserve the right to leave the event due to rain or intense heat (if the event is held outdoors without a tent). No refunds will be given.

For outdoor bookings, it is the client’s responsibility to provide an alternate indoor location in case of inclement weather.

We reserve the right to modify, limit, or cancel outdoor performances for the safety of our performers.
Parking
-
For safety and maintaining the magic, our performers will park down the street and out of sight for most private events.

On the day of the event, if the performers cannot find street parking, the client will be contacted and asked for an alternative suggestion. If the performer needs to park in a driveway as a last resort, please keep all guests away and out of sight for safety and maintaining the magic.

If the event requires paid parking, that is the responsibility of the client and can be pre-paid with the booking or paid in cash to the performer at the end of the event.

For corporate clients, we require dedicated parking reserved for our performers that is at maximum one block away from the event venue. We will communicate how many total spaces our performers will need.
Photo Release
-
On the booking form, you are required to answer whether our performer(s) can take photos of guests at the party/event.

Any photos taken by the client and sent to the company or posted in public spaces, such as social media and review sites, are hereby signed as release to be used by Magic Hour Character Company for website, social media, and promotional use.

You may take photos of the performance for personal use only. Commercial use or redistribution without our written permission is prohibited.
Discipline and Non-Participation

The performer is only an entertainer and will not discipline disruptive behavior or force children to participate.

At least one adult is required to be present with the children and performer during the event.
Performer Preference
-
All our performers are specially-trained entertainers who love working with children.
-
We will send the best performer available to your event.
Activities and Itinerary
-
Each package itinerary is carefully scheduled to support our company mission of connection between the characters and children.
-
Special requests must be submitted upon booking and cannot be guaranteed.
-
Itinerary may be modified in the moment at your event to best suit the needs of your guests.
Safety and Liability

The client agrees to hold and keep harmless Magic Hour Character Company and its performers from any and all property damage and/or bodily injury damage caused by the client’s guests.

The client agrees to not hold Magic Hour Character Company responsible for inclement weather or other Acts of God that may cause cancellation of the event.

The client must inform Magic Hour Character Company of any allergies to items such as face paint prior to the event.

Our performers are trained to always keep the safety of your guests in mind and always behave appropriately. We require a safe, respectful environment during all events. If ever there is a situation where the performer(s) feels unsafe, they will address the issue with the client. If the issue is not resolved, the performer will leave without a refund.

We reserve the right to end a performance early without warning and without a refund if a performer feels unsafe, is harassed, or is subjected to inappropriate behavior.
Face Painting Safety Guidelines Policy

Please note: We use FDA-approved and hypoallergenic water-based face paint.
-
We will not paint children under two years old.
-
If a parent or legal guardian is unsure of their child’s skin sensitivity, you can request a swatch in a small area, usually on the hand.

We will not paint if there are open wounds, among other skin conditions and/or highly transmissible infections such as conjunctivitis, lice, cold or flu, or chicken pox and we reserve the right to deny the face paint to whomever presents symptoms of infection.

Use a warm damp rag to take off the face paint.
-
The face paint should not be left on for an extended period of time.​
Non-Disparagement

The Client agrees not to make any public statement, written or oral, that intentionally defames, disparages, or otherwise harms the reputation of Magic Hour Character Company, its representatives, or performers. This provision does not prevent the Client from providing honest feedback directly to Magic Hour Character Company or expressing opinions in good faith where required by law or legal process.
Reputation Concerns and Communication

If the Client becomes aware of any materially false and/or damaging public statements made about Magic Hour Character Company that may significantly affect the business relationship, the Client agrees to notify Magic Hour Character Company when reasonable and appropriate. This clause is not intended to create a legal obligation, but rather to foster open and cooperative communication between the parties.
Service Delivery and Client Responsibilities​

Service Conditions: You are responsible for providing accurate event details (date, time, location) at the time of booking. We are not responsible for issues arising from incorrect information.

Setup and Access: The client must ensure sufficient space, power, and setup conditions for the entertainment service. Failure to meet setup requirements may limit service delivery without refund eligibility.

Force Majeure: We are not liable for cancellations or delays caused by unforeseen circumstances (e.g., severe weather, power outages, traffic, illness, etc.). In such cases, we will offer rescheduling or a partial refund at our discretion.
Chargebacks and Dispute Policy

Initiating a chargeback without first contacting us to resolve the issue is considered a breach of contract.

We reserve the right to dispute invalid chargebacks and present evidence of service delivery (e.g., signed contracts, photos, invoices, etc.) to defend against fraudulent claims.

Chargeback Fees: In the event of an invalid chargeback, you agree to reimburse us for any fees, legal expenses, and administrative costs incurred.
Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting on our website or communicating them to you directly. Continued use of our services constitutes your acceptance of any changes.
